February Update on MSI's Legal Efforts

Here's a brief look at our ongoing legal efforts from around the state.

Maryland Shall Issue v. Montgomery County - Carry, Privately Made Firearms, Other Firearms Restrictions

MSI argued this case in federal district court on February 6th in support of a motion for a preliminary injunction against Montgomery County’s carry ban in Bill 21-22E. We do not know when the Court will render a decision, but we look forward to its ruling.

Hulbert v. Pope - First Amendment, Fourth Amendment, Qualified Immunity

The US Court of Appeals for the Fourth Circuit has tentatively scheduled oral argument in this case for the first week of May. The finalized date will be posted to the case page as soon as it becomes available. The Court will provide a live audio stream from its YouTube Page.

Maryland Shall Issue v. Moore - Maryland Handgun Qualification License

Yes, you read that right. Since Larry Hogan is no longer the current Governor of Maryland, Wes Moore is, ex officio, now the named defendant. Oral argument in this case is scheduled for March 10th in the US Court of Appeals for the Fourth Circuit. The Court will provide a live audio stream from its YouTube Page.

Maryland Shall Issue v. Anne Arundel County - Compelled Speech of Firearms Dealers

This case has been fully briefed since early December and a decision could come at any time. Interestingly, reference was made to this lawsuit during the hearing on HB 307, by the Executive Director of Marylanders to Prevent Gun Violence, saying that they’re “treading carefully to make sure we don’t step on any First Amendment rights.”

August 2023 Legal Update

Novotny v. Moore - Challenge against aspects of SB 1 and current public carry restrictions

Maryland Shall Issue, the Second Amendment Foundation, the Firearms Policy Coalition, and three individuals have challenged SB 1. That bill passed this last Session of the General Assembly places many unconstitutional restrictions on the right to carry with a permit in Maryland. The case is styled Novotny v. Moore and has been consolidated with Kipke v. Moore in federal district court in Baltimore. Kipke was brought by the Maryland State Rifle and Pistol Association. Plaintiffs in both cases have filed motions for preliminary injunctions and motions for summary judgment with the aim of stopping enforcement of certain restrictions placed by SB 1 by October 1st, the bill’s effective date. Briefing is ongoing in both cases and then the court will decide whether to hold an oral argument and simply move to the issuance of a decision. The court is not required to decide the case within any set time. We will provide updates of importance as they occur. Find all of the filings in both of these cases HERE.
